Section 201 of the Notification and Federal Employee Antidiscrimination and Retaliation Act of 2002 (No FEAR Act) requires Federal agencies to notify all employees, former employees, and applicants for Federal employment of the rights and protections available to them under the Federal Antidiscrimination Laws and Whistleblower Protection Laws. Section 203 of The No FEAR Act requires each agency, no later than 180 days after the end of each fiscal year, to submit an Annual Report to the Speaker of the U.S. House of Representatives, the President pro tempore of the U.S. Senate, the Committee on Governmental Affairs of the Senate, the Committee on Government Reform of the House of Representatives, each committee of Congress with jurisdiction relating to the agency, the Chair of the Equal Employment Opportunity Commission (EEOC), and the Attorney General of the United States. Regulations from the Office of Personnel Management (OPM) implementing the No FEAR Act, Code of Federal Regulations (C.F.R.) Part 724, Subpart C, also require the submission of this annual report to the Director of OPM.
Section 301 of the No FEAR Act requires each federal agency to post summary data pertaining to complaints of employment discrimination filed against it by employees and applicants for employment under 29 C.F.R. Part 1614. The specific data to be posted is described in section 301(b) of the No FEAR Act and 29 C.F.R. 1614.704.
