Subject: PERFORMANCE-BASED SERVICE CONTRACTING (PBSC)
CHECKLIST
- 1.Purpose:
- To distribute the PBSC
Checklist issued by the Office of Federal Procurement Policy
on August 8, 1997.
- 2. Effective Date:
- Effective Upon Issuance.
- 3. Expiration Date:
- This policy release remains effective until canceled
or superseded.
- 4. Background:
- The checklist may be used as a guide for development
of a performance-based solicitation, contract or task order. It contains "Minimum Mandatory
PBSC Requirements" which, it says, must be present for an acquisition to be classified as
performance-based. Please note, however, that these four minimum mandatory requirements have
been superseded by Federal Acquisition Regulation 37.601 issued on August 22, 1997, as part of
Federal Acquisition Circular 97-1. We will use the text of FAR 37.601 to determine whether or
not an acquisition is performance-based.
- 5. Action Required:
- The checklist should be distributed to contracting
and program officials for developing performance-based documents and for determining, in
conjunction with the FAR, whether an acquisition for services is
performance-based.
