“It clarifies that the BLM will continue to require, as it has been doing in practice for awhile, an on site inspection of the lease prior to an APD being complete. That will be the case whether the lease is split estate or not. When it is a case of split estate the private surface owner will be given the opportunity to participate in that on site inspection with the BLM and the operator if they so chose.”
